TERMS OF SERVICE

These Terms of Service apply to your use of the J&R Mechanical Services website and to workshop, roadside, field-service, and related automotive services provided by J&R Mechanical Services in South Africa.

By using this site, requesting a quote, booking a job, or authorising repairs, you agree to these terms, subject to mandatory rights under South African law, including the Consumer Protection Act, 68 of 2008 (CPA) where applicable.

1. Booking and Work Authorisation

You may request services by website form, phone, WhatsApp, or email. We may require clear authorisation before commencing paid work. Additional defects discovered during diagnostics may require further approval before extra work is performed.

2. Quotes, Estimates, and Diagnostics

Website, phone, or WhatsApp estimates are indicative until we physically inspect and diagnose the vehicle or equipment. A written quote may exclude hidden faults not reasonably discoverable at first inspection. If the scope changes, we will provide an updated estimate for approval.

3. Parts and Consumables

Unless expressly agreed otherwise, we source parts and consumables through our approved channels. Availability, supplier lead times, and import delays may affect delivery dates. If you supply your own parts, we may decline fitment where safety, quality, or compatibility risks are identified.

4. Customer-Supplied Parts

Where we agree to fit customer-supplied parts:

  • Fitment may be refused if parts appear unsafe, counterfeit, damaged, or incorrect.
  • Any supplier warranty remains between you and your supplier unless stated in writing.
  • We are not responsible for defects in parts that we did not supply.

5. Payment Terms and Collection

Unless otherwise agreed in writing:

  • Payment is due on presentation of invoice or on collection, whichever is earlier.
  • Vehicles and equipment may be retained until outstanding accounts are settled as allowed by law.
  • If collection is delayed after completion notice, reasonable storage charges may apply.

6. Warranties and Consumer Rights

We stand behind workmanship and parts supplied by us, subject to fair wear and tear, normal usage, manufacturer requirements, and proper maintenance. Nothing in these terms limits rights that cannot be lawfully excluded under the CPA or other applicable law.

If you believe a repair is defective, notify us promptly and provide a fair opportunity to inspect and rectify the issue.

7. Turnaround Times and Delays

Any completion date is an estimate. We are not liable for reasonable delays caused by supplier issues, hidden defects, force majeure events, utility outages, labour disruptions, or circumstances outside our direct control.

8. Road Testing and Vehicle Handling

You authorise reasonable test drives and workshop movement necessary for diagnostics, calibration, and quality control. We will take reasonable care of your vehicle while in our possession.

9. Liability Limits

To the maximum extent permitted by law, we are not liable for indirect or consequential losses, such as loss of profit, downtime, or business interruption. Our liability for direct loss remains subject to applicable law and the specific facts of each claim.

10. Website Use, External Links, and Availability

Website content is provided for general information and may change without notice. External links are provided for convenience; we are not responsible for third-party content or availability. Site access may be interrupted for maintenance, updates, or technical faults.

11. Electronic Communications

By contacting us electronically, you agree that communications and records may be exchanged electronically and can satisfy legal communication requirements where permitted by the Electronic Communications and Transactions Act, 25 of 2002 (ECTA).

These terms are governed by the laws of the Republic of South Africa. Before formal legal action, both parties should attempt to resolve disputes in good faith through direct engagement.
